Thanks to all supporters of Morgan and the Orca Coalition

The Orca Coalition want to thank their supporters.
Many people helped out gathering information, translating, donated photos, shared Morgan’s story with others or supported us financially during the two and a half year in our fight for her freedom.

Despite we did not succeed returning Morgan back to sea, we should not forget we did make a difference. Without your help we would never have come this far, not only the means but also your support on Face Book and your perseverance gave us the energy in this long struggle.

It was great to see how we all have functioned as a team. How this team become bigger and bigger in these two and a half year and connected people worldwide. The movement against captivity is growing stronger every day. The dolphinarium in Harderwijk (the Netherlands) has indicated not to have acted in error and will take the same decision in a next similar case. So, the fight is far from over.

We would like to thank the Free Morgan Foundation for their expertise and all the reports which were important in the juridical process.
We hope your support for Morgan will continued and therefor support the Free Morgan Foundation.

De Orka Coalitie wil iedereen die zich heeft ingezet voor Morgan hartelijke danken.
Veel mensen hebben de Orka Coalitie voorzien van informatie, foto’s en financiële middelen tijdens de twee en een half jaar durende strijd voor Morgan.

Ondanks het vooralsnog niet gelukt is Morgan terug naar zee te krijgen, moeten we niet vergeten dat we voor verandering gezorgd hebben. Zonder hulp zouden wij nooit zo ver gekomen zijn, niet alleen de middelen, maar ook de support op Face Book en het doorzettingsvermogen gaf ons energie.

Het was geweldig te zien hoe wij allen als een team gefunctioneerd hebben. Hoe deze groep groter en groter is geworden en mensen wereldwijd met elkaar verbonden heeft. Hierdoor groeit ook het steeds sterker wordende verzet tegen gevangenschap van walvisachtige.
Het dolfinarium in Harderwijk (Nederland) heeft aangegeven niet fout gehandeld te hebben en bij een eerstvolgend zelfde geval dezelfde beslissing te zullen nemen. Dat wil dus zeggen dat de strijd nog lang niet voorbij is.

Bij deze willen wij ook de Free Morgan Foundation bedanken voor hun expertise en de rapporten die een belangrijke bijdrage leverde in het proces.

Wij hopen dat de support voor Morgan zal worden voortgezet bij de Free Morgan Foundation.
Graag wil ik jullie bedanken namens de vertegenwoordigers van de organisaties binnen de Orka Coalitie; Alex, Barbara, Dos, Elisa, Geoffrey, Nancy en Wietse.

We gaan door, om er voor te zorgen dat walvisachtige in Nederland beschermd worden tegen uitbuiting door de entertainment industrie.
Zoals u wellicht hebt vernomen zijn de Sea First Foundation en Dolphinmotion samen met de Free Morgan Foundation in beroep gegaan bij de raad van state. Hoogstwaarschijnlijk zal deze rechtszaak na de zomervakantie plaatsvinden. Wij houden u hiervan op de hoogte.

Appeal in lawsuit orca Morgan

Amsterdam, February 2013 – In December 2012 the court in Amsterdam adjudicated in the lawsuit about orca Morgan. The Orca Coalition started the lawsuit to bring Morgan back to nature, supported by international scientists and experts united in the Free Morgan Foundation. The verdict of the judge that Morgan can stay in captivity will be challenged in appeal.

The Orca Coalition is satisfied that the Free Morgan Foundation continues. Spokesperson Barbara van Genne: “The Orca Coalition was started in 2010 to prevent that Morgan would silently disappear in the dolphinarium industry. We had not expected that it would come to a long lasting lawsuit. Although we are terrified that Morgan did end up in an entertainment park, we are happy that this did not happen silently. The lawsuit started a public debate and we are sure that a next time, things will be different.”

The Orca Coalition chose not to appeal against the verdict of the judge. “The trade off between the chance that we can still get Morgan released with an appeal and the time and means this would cost, made us decide not to continue the lawsuit. Luckily, the scientists of the Free Morgan Foundation have the opportunity to do so, thanks to sponsor Sam Simon, and so they will. They work together with the legal parties of interest Dolphinmotion and the Sea First Foundation and advocate Marq Wijngaarden, that represented Morgan from the beginning.

Hoger beroep in rechtszaak orka Morgan

Amsterdam, februari 2013 – In december 2012 deed de rechtbank Amsterdam uitspraak in de rechtszaak over orka Morgan. De Orka Coalitie spande de rechtszaak aan om Morgan terug te brengen naar de natuur, gesteund door internationale wetenschappers en deskundigen verenigd in de Free Morgan Foundation. De uitspraak van de rechter dat Morgan in gevangenschap mag blijven, zal in hoger beroep aangevochten worden.

De Orka Coalitie is tevreden dat de Free Morgan Foundation de strijd voor Morgan voortzet. Woordvoerder Barbara van Genne: “De Orka Coalitie is in 2010 opgezet om te voorkomen dat Morgan stilletjes zou verdwijnen in de dolfinariumindustrie. We hadden destijds niet verwacht dat het tot een langdurige rechtszaak zou komen. Hoewel we het verschrikkelijk vinden dat Morgan tóch in een pretpark terecht is gekomen, zijn we blij dat dat niet stilletjes gebeurd is. De rechtszaak heeft een publiek debat ontketend en we zijn ervan overtuigd dat het een volgende keer anders zal gaan.”

De Orka Coalitie heeft ervoor gekozen niet in hoger beroep te gaan tegen de uitspraak van de rechter. “De afweging tussen de kans dat we Morgan alsnog vrij kunnen krijgen met een hoger beroep en de tijd en middelen dat dit zou kosten, deed ons besluiten niet verder te gaan met de rechtszaak. Gelukkig bleken de wetenschappers van de Free Morgan Group dankzij sponsor Sam Simon wel de mogelijkheid te hebben om verder te gaan, en dat zullen ze doen in hoger beroep. Ze zullen hiervoor samenwerken met belanghebbende stichting Dolphinmotion, Sea First Foundation en advocaat Marq Wijngaarden, die Morgan vanaf het begin vertegenwoordigd heeft.

Judges to give long-awaited verdict in orca case

Thursday, December 13th at 13:30, the Dutch courts will give judgement in the case of orca Morgan. The lawsuit that was initiated by the Orca Coalition two years ago, saw its final hearing on November 1st. The court then announced to come with a verdict as soon as possible, especially because there are concerns about the welfare of the young orca.

Loro Parque, the Spanish amusement park where orca Morgan is being held since November 2011, tested Morgan’s hearing shortly after the last hearing of the court. The company then concluded that the animal hears less than the other orcas.

This is interesting since Morgan was not showing any hearing problems when she left she left the dolphinarium at Harderwijk, where she was previously kept. The dolphinarium had previously told the media that Morgan was responsive to sound, which might suggest that the new statement is misleading and aimed at swaying the judge’s ruling in favour of not releasing the orca, which many experts have concluded to be a good candidate for release back into the wild.

The Orca Coalition and the Free Morgan Foundation (a team of orca-experts that assists the Orca Coalition in the lawsuit) are openly questioning the findings of Loro Parque that Morgan’s hearing would be impaired. It looks more like an attempt by the marine animal industry to keep the valuable animal in captivity and disrupt any attempts of releasing her.

Either way, with the help of many orca-experts from around the world, orca Morgan has a place to go to in Norway. Several possibilities are open to give her a bright future, with a richer environment for her to live in, than a life in a small concrete tank at the entertainment park Loro Parque. The Orca Coalition hopes the judge will give orca Morgan this change when tomorrow’s ruling tomorrow will seal her fate.

Langverwacht vonnis rechtbank over vrijlating orka Morgan

Donderdag 13 december om 13.30 uur doet de rechtbank Amsterdam uitspraak in de zaak orka Morgan. De bodemprocedure die ruim twee jaar geleden werd aangespannen door de Orka Coalitie, kwam op 1 november jl. voor de derde keer voor de rechter. De rechtbank kondigde toen aan zo spoedig mogelijk uitspraak te doen, omdat er zorgen zijn over het welzijn van de orka.

Loro Parque, het pretpark waar orka Morgan sinds november 2011 gehouden wordt, deed kort na de laatste hoorzitting een gehoortest bij Morgan. Daarop lieten zij via officiële berichtgeving weten dat het dier minder goed hoort dan de andere orka’s. Opvallend, omdat Morgan nog niet slechthorend was toen zij Harderwijk verliet. Het Dolfinarium liet immers in de media nog weten dat Morgan ‘goed’ reageerde op geluidsopnamen van de andere orka’s in Loro Parque. Hoe de orka de gehoorschade opgelopen kan hebben, is de Orka Coalitie een raadsel. Er bestaan antibiotica die slechthorend- of doofheid tot gevolg kunnen hebben, maar de Orka Coalitie gaat ervan uit dat Loro Parque hiervan op de hoogte is. Het bericht van de slechthorendheid is overigens nog niet bevestigd, doordat Loro Parque onafhankelijke wetenschappers niet de mogelijkheid biedt om de gehoortest te herhalen.

Vanwege de raadselachtige oorzaak en de opvallende timing van de berichtgeving, betwijfelen de Orka Coalitie en de Free Morgan Foundation (het team van orka-deskundigen dat de Orka Coalitie in de rechtszaak bijstaat) of Morgan echt slechthorend is. Het lijkt op een zoveelste poging van de industrie om het waardevolle dier niet vrij te hoeven laten. Slechthorend, doof of volledig gezond, voor Morgan is een plekje in Noorwegen gereserveerd. Er zijn verschillende mogelijkheden voor haar in de toekomst, die voor een rijkere omgeving zorgen dan een leven in Loro Parque. De Orka Coalitie hoopt op een uitspraak die Morgan spoedig de mogelijkheid geeft achter vis aan te jagen. Dit doen orka’s immers niet met hun oren, maar met sonar.

New attempt of commercial industry to keep valuable orca

Amsterdam, 15 November 2012 – Today Loro Parque released the news that orca Morgan is very hard of hearing or even deaf. A conspicuous notice in a conspicuous time. Orca Morgan has been in the park and despite of that the research was done after the last hearing on her captivity, and shortly before the long-awaited ruling of the court. The Orca Coalition sees this as another attempt by the commercial industry to keep the valuable animal in their possession.

For those who followed the lawsuit for the past two years, this is also a conspicuous notice. They remember the press release from the Dolphinarium and Loro Parque from more than a year ago which stated that Morgan responded so well to the sound recordings of the orcas in Loro Parque. When Morgan was still in the Dolphinarium, there seemed nothing wrong with her hearing. Only after she moved to Loro Parque suspicions of deafness were announced. This investigation was a long wait, until the moment after the hearing on her release and before the ruling on this. When a spokesperson of Loro Parque announced in the hearing on November 1st that the research would be done the following week, even the judge spoke of a remarkable timing.

As before, the commercial industry itself selected and hired the scientists for the scientific research, and once again the specialized and experienced scientists of the Free Morgan Foundation are excluded. The involved researchers who have examined whether Morgan is deaf, also have ties with the Dolphinarium and Sea World. The Orca Coalition has asked for over a year, for independent research and this was refused. The Orca Coalition therefore draws into question whether this was independent research.

The Orca Coalition suspect that this is a final attempt to influence the judges. The umpteenth predictable attempt to keep Morgan in captivity.

Nieuwe poging van commerciële industrie om waardevolle orka te kunnen houden

Amsterdam, 15 november 2012 – Vandaag bracht Loro Parque naar buiten dat orka Morgan zeer slechthorend of zelfs doof is. Een opvallende mededeling op een opvallend tijdstip. Orka Morgan bevindt zich al een jaar in het park en desondanks werd het onderzoek pas na de laatste hoorzitting over haar gevangenschap gedaan, en kort voor de langverwachte uitspraak van de rechter. De Orka Coalitie ziet dit als een nieuwe poging van de commerciële industrie om het waardevolle dier in hun bezit te kunnen houden.

Voor degenen die de rechtszaak de afgelopen 2 jaar gevolgd hebben, is dit bovendien een opvallende mededeling. Zij herinneren zich het persbericht van het Dolfinarium en Loro Parque van ruim een jaar geleden dat Morgan zo goed reageerde op de geluidsopnamen van de orka’s in Loro Parque. Toen Morgan nog in het Dolfinarium verbleef, leek er dus niks mis met haar gehoor. Pas na haar verhuizing naar Loro Parque werden vermoedens van doofheid uitgesproken. Het onderzoek hiernaar liet echter nog lang op zich wachten, naar nu blijkt tot het moment ná de hoorzitting over haar vrijlating en vóór de uitspraak hierover. Toen een woordvoerder van Loro Parque tijdens de hoorzitting van 1 november aankondigde de week erop onderzoek te gaan doen naar het gehoor van Morgan, sprak zelfs de rechter van een opvallende timing.

Zoals al eerder heeft de commerciële industrie zelf wetenschappers uitgekozen en ingeschakeld voor wetenschappelijk onderzoek, en opnieuw worden de gespecialiseerde en ervaren wetenschappers van de Free Morgan Foundation op afstand gehouden. De betrokken onderzoeksinstituten die onderzocht hebben of Morgan doof is, hebben bovendien banden met het Dolfinarium en Sea World. De Orka Coalitie vraagt al een jaar om onafhankelijk onderzoek en dit werd geweigerd. De Orka Coalitie trekt daarom in twijfel of er sprake is van onafhankelijk onderzoek.

De Orka Coalitie vermoedt dat dit een laatste poging is om de rechters te beïnvloeden. De zoveelste voorspelbare poging om Morgan in gevangenschap te kunnen houden.

December 13th: Decision on the merits concerning Morgan!

The merits procedure hearing was well attended by many people supporting our cause to free Morgan, including our expert board with Jean-Michel Cousteau, Jeff Foster, Lara Pozzato and Ingrid Visser. After the merits the expert board of the Free Morgan Foundation made an extensive, detailed as well as a brief summary. The outcome of the merits are expected at 13 December 2012.

Instead of the 3 to 4 hours hearing what was planned, the hearing took 8 hours! The juridical issue, the mental and physical state of Morgan now, the past, how decisions were made and based on, the Orca Coalition not being heard in previous meetings with Dolfinarium Harderwijk B.V. and the Ministry, the last summery hearing which shipped Morgan away, the future release, financial matters, everything was mentioned and discussed and handled with care by the judges.

Let us have faith in the law system and protection measures regarding wild life. Hope to see you all in court for the decision on December 13th at 13.30 Parnassusweg 220 Amsterdam.

Overwhelming international attention for court case Orca Morgan

Prince Albert II of Monaco supports the court case, Cousteau will be present at the court

Amsterdam, 31 October 2012 – On Thursday, November 1st, more than two years after the wild orca Morgan was taken to land, the case of her imprisonment will be in court again. Although since November 2011 the orca is no longer held in the Netherlands, but in Tenerife, the question whether the protected animal may be held captive remains to be answered. Three judges will come up with an answer that is not only of great importance for Morgan, but also for all other wild animals that will one day come in contact with humans. That the world famous sea protector Jean-Michel Cousteau and orca-expert Jeff Foster (known from releasing the orca from ‘Free Willy’), are being present, and the support for Morgans freedom of Prince Albert II of Monaco, emphasizes how important this issue is for the protection of nature and the animals that live there.

In June 2010, Morgan was found weakened in the Wadden Sea and collected in Dolphinarium Harderwijk, with the aim to strengthen her back and release. But soon it turned out that the dolphinarium had other plans with the young orca, and although their plans were stopped during the first trial in September 2011, in November 2011 the judge gave permission for Morgan to be moved to Loro Parque in Tenerife. This entertainment parc would be a temporary solution for the lack of space and companion where Morgan was struggling with at the dolphinarium. The court ruling ended with the remark that it was possible to rehabilitate Morgan from Loro Parque to the wild.

Almost a year of captivity passed in Tenerife and that did no good for Morgan. Although on paper Loro Parque is an improvement compared to Dolphinarium Harderwijk, thanks to a larger basin and company of other orcas, in practice there is much that would indicate otherwise. Apart from the fact that the larger basin still is unimaginably much smaller than the natural habitat of the killer whale, the relationship between the orcas in Loro Parque is severely disrupted. Boredom, frustration and unnatural group structure leads to aggression between orcas, with the result that Morgan is within one year covered with scars. Morgan also has concrete bite which stereotypical behavior.

During the trial, the Orca Coalition will again advocate for the full commitment of the government to allow wild animals wild and not to disappear as an attraction in an entertainment park. “It can not be that commercial establishments like Dolphinarium Harderwijk are given freehand when it comes to the protection of animals. These are precisely the settings where animals need to be protected against, “said a spokesman for the Orca Coalition. The lawsuit is supported by international scientists and experts, united in the Free Morgan Foundation. Included Jean-Michel Cousteau and Jeff Foster will attend the trial. Foster has extensive experience with the expansion of orcas and dolphins, including the world famous killer whale from ‘Free Willy’.
